ACCOUNTS
& BILLING
1. ALL customers must agree to accept full responsibility and liability
and must pay for all usage accrued on their account, if unauthorized
usage is suspected you must notify us immediately.
2. It is your responsibility to maintain the same security of your password
as you would a PIN number; you are also advised to carry out a virus
scan, at least weekly, on your computer. Outside parties can unlawfully
obtain your username and password through these viruses.
3. Monthly Accounts are defined per calendar month and are billed from
the first of the month to the end of the month.
4. Termination must be given by email, fax, post or personally, definitely
not by telephone.
5. Payments are automatically debited from credit cards in the first
week of each month. Australia Connect accepts the following credit cards:
Visa, MasterCard, Bankcard, Diners Club & American Express.
6. We generally do not accept payments other than credit cards, however
special arrangements can be made for approved customers. In such cases
customers must write their user name on the back of cheque/money orders.
Australia Connect will notify customers via email that payment is required.
A $50.00 security deposit is required for this service.
7. Australia Connect will not issue refunds unless it has not been possible
to establish an initial connection between the client and our server.
8. Termination of accounts. Accounts may be cancelled by giving at least
seven days notice of termination prior to the end of the month in which
termination is required.
9. Should you require non-electronic copies of invoice/receipt a fee
of $5 for mailing and $2 for faxes will be charged per month. Please
issue a request to admin@acon.com.au if you require this service.
10. A reconnection fee of $10.00 applies to all accounts disconnected
due to non-payment. Should the account be suspended or terminated, customers
are still required to pay any past due account charges before reconnection.
11. Australia Connect reserves the right to change pricing plans without
notice.
12. Legal action will be taken by Australia Connect to recover all outstanding
payments.
13. Australia Connect Pty Ltd is not liable to The Customer or any other
person for:-
· any cost, loss or liability (including loss of profit or other
consequential damage) arising from Australia Connect's supply or failure
or delay in supplying and goods or Services.
DOWNLOADS
1. Customers can view their account status, usage and billing records
online at www.acon.com.au.
2. Customers will be notified via email at the beginning of each month
that invoices are ready and can be inspected and printed from www.acon.com.au
under the member's section. We require payment within seven (7) days
of this notification to avoid any disconnection of services. All customers
can monitor their download usage online. All customers agree to take
full responsibility of their accounts
3. Although Australia Connect keeps logs of our server's usage we do
not filter or scrutinize data going to you. To ensure your privacy or
that the material is free from viruses we strongly recommend you scan
all incoming emails, transactions etc over the Internet for viruses
(i.e. programs, email etc).
4. Any unused portion of downloads included in the monthly fee are not
rolled over into the following month.
5. Non credit card customers will loose all special privileges if accounts
are not paid on time.
6. For billing purposes all sessions are rounded up to the nearest five
minute increment and downloads are rounded up to the nearest complete
megabyte.
TIME SESSIONS
1. All Accounts, except permanent connections, have a session limit
of 5 hours
(There is a 10 minute idle/waiting period implemented after disconnection
before reconnection is possible.)
2. Unlimited hourly plans are not designed for continuous connection,
refer to Corporate Accounts for 24-hour connection.
SYSTEM USAGE
1. All communication will be sent via email to your @acon.com.au or
@surfthe.net.au account.
2. Australia Connect is not liable for any costs or disruptions associated
with remote telephone services. Australia Connect covers the Sydney
Metropolitan Area only. Normal telecommunications charges apply to all
plans. Long distance and community call charges may apply.
3. Although we try to maintain good modem to client ratio (1:5) we cannot
guarantee a dial in connection every time. Australia Connect provides
access at 56K - 256K - depending on account plan. We cannot guarantee
connection speed (due to telephone lines, modem speed, etc).
4. Enabling servers or providing any public information service from
a computer connected via any of our account plans are prohibited.
5. Australia Connect Pty. Ltd. will not accept responsibility for offenses
caused by material received via the Internet. Users sending and/or storing
via Australia Connect any offensive material e.g. racism, pornography,
violence, slander/liable, personal abuse; in any context, or using their
account to harass or hinder others or using false names/e-mail addresses
should be aware that any breach will result in instant closure of the
account.
6. Customers shall not use, nor permit any other party to use, the Service
for sending to any person or forum any message, electronic mail or other
communication which is offensive or abusive or of an indecent, obscene
or menacing character, or for persistently sending messages without
reasonable cause or for the purpose of causing annoyance, inconvenience
or needless anxiety to any person.
7. Accounts are granted for one computer and/or one user. Users are
not permitted to allow others to use their accounts on other computers.
Any account tagged as being logged on twice at the same time must accept
the liability for an extra user account being charged to their account
or the account being terminated.
8. Periodically we conduct maintenance and upgrades, which may temporarily
affect connection. We will endeavor to minimize interruptions to normal
service. Scheduled maintenance is usually carried out overnight with
prior notification sent via email.
9. Homepage space is provided free of charge and we do not provide any
technical support to building and maintain your page.
10. Technical support covers dialup connection difficulties, browser
setup, mail setup for Internet mail, Netscape mail and The Bat. We provide
technical support for Windows 95, 98 and Mac OS. For technical difficulties
on Windows NT please contact your systems administrator.
11. Any breach of these Terms and Conditions will result in the immediate
suspension of the account.
12. Australia Connect reserves the right to revise these Terms and Conditions.
